Legal psilocybin therapy in Czechia (2026): who qualifies and when it starts

Last updated · Trial statuses checked 23 October 2026 · Published by Psyche Vibes Ltd, London

The short answer. Since 1 January 2026, Czech law allows psilocybin as a medical treatment for defined forms of depression. Only a psychiatrist, or a doctor with a specialisation in medical psychotherapy, can prescribe and give it, and only after registered medicines have failed or were not tolerated (Government Regulation 552/2025).

It has not started yet. On 23 March 2026, the National Institute of Mental Health (NUDZ) said it was "not yet possible to apply for psilocybin treatment or to register for a waiting list". It expected the launch in the second half of 2026, once reimbursement from public health insurance is finalised (NUDZ). As of 23 October 2026 we found no public announcement that treatment had begun.

What the law says

Act No. 270/2025 Coll. amended Czech drug and medicines law, with effect from 1 January 2026. The detailed rules are in Government Regulation No. 552/2025 Coll., published on 17 December 2025, which also took effect on 1 January 2026. Psilocybin must also be used in line with the clinical guideline on psilocybin-assisted psychotherapy (Czech Psychiatric Society).

This is a national medical route, not an EU approval. No psilocybin medicine is authorised by the EU or under EMA evaluation: see our EMA approval tracker and the Czechia tracker row.

Who qualifies

Under the regulation, psilocybin can be used only where registered medicines were ineffective or caused documented intolerance, and only for (Regulation 552/2025, §2):

  1. depressive disorder associated with cancer;
  2. clinically serious depressive disorder without psychotic symptoms;
  3. a sudden worsening of another serious neuropsychiatric or mental disorder that seriously threatens the patient's life, where this is sufficiently supported by scientific evidence.

A psychiatrist decides whether a patient is suitable. One prospective provider, Psyon, says treatment will at first be only for treatment-resistant depression, and that expressing interest "does not mean automatic inclusion" (Psyon).

How treatment works under the rules

When it starts

NUDZ says the law formally allows psilocybin treatment in specialised healthcare facilities, but that availability depends on finalising reimbursement under public health insurance. In March 2026 it expected the launch in the second half of 2026 (NUDZ, English; Czech). Psyon also says treatment is likely in the second half of 2026 (Psyon). We will update this page when treatment opens.

Questions and answers

Is psilocybin therapy legal in the Czech Republic?

Yes, as a medical treatment, since 1 January 2026. Psilocybin can only be prescribed and given by a doctor specialised in psychiatry (or with a special specialisation in medical psychotherapy), for defined depressive disorders, after registered medicines have not worked or were not tolerated.

Who qualifies for psilocybin treatment in Czechia?

The regulation lists three situations: depressive disorder linked to cancer; clinically serious depressive disorder without psychotic symptoms; and a sudden worsening of another serious neuropsychiatric or mental disorder that seriously threatens the patient's life, where scientific evidence sufficiently supports it. In each case registered medicines must have been ineffective or not tolerated.

When does psilocybin treatment start in Czechia?

The law has been in force since 1 January 2026, but treatment depends on reimbursement from public health insurance being finalised. On 23 March 2026, NUDZ said patients could not yet apply or join a waiting list, and expected the launch in the second half of 2026. As of 23 October 2026 we found no public announcement that treatment had started.

Can I sign up for psilocybin therapy in Czechia now?

According to NUDZ, not yet: it said in March 2026 that it was not yet possible to apply for treatment or register for a waiting list. Decisions will be made by the treating psychiatrists under the clinical guideline.

How much psilocybin is allowed per dose?

The regulation caps a single dose at 35 mg and 0.4 mg per kg of body weight, with no more than 75 mg and three doses in a calendar month, at least seven days apart. The doctor must supervise the patient for at least 4 hours (doses under 15 mg) or 6 hours (15 mg and above), until the effects have fully worn off.

Does this make magic mushrooms legal in Czechia?

No. This framework covers psilocybin prescribed by a psychiatrist and taken under medical supervision in healthcare. It does not allow non-medical use, and this guide covers only the medical route.
